Along the way, she successfully introduced a new approach to the theory of the unconscious without abandoning the principles set forth by Freud. In her first biography of a fellow psychoanalyst, the prolific Kristeva considers Klein's life and intellectual development, (...) weaving a narrative that covers the history of psychoanalysis and illuminates Kristeva's own life and work. In the summer of 2008, the Spanish legislature resolved to grant great apes (though not all simians) basic human rights. While the decision to grant such rights came about largely through the lobbying efforts of the Great Ape Project (GAP), the decision has potential reverberations throughout the scientific world and beyond in its implications for shaping determinations of “what is human.” Such implications do not appear to be lost on various groupings of scientists who have spoken about their opinions about (...) the case and the project in general. These groupings of scientists, I argue, using the work of Mary Douglas and others, can be compared to “tribes” actively advancing and defending their classifications of the “human” in a bid for a retention or expansion of power. Patients have received experimental pharmaceuticals outside of clinical trials for decades. There are no industry-wide best practices, and many companies that have granted compassionate use, or ‘preapproval’, access to their investigational products have done so without fanfare and without divulging the process or grounds on which decisions were made. The number of compassionate use requests has increased over time. Driving the demand are new treatments for serious unmet medical needs; patient advocacy groups pressing for access to emerging treatments; internet platforms (...) enabling broad awareness of compelling cases or novel drugs and a lack of trust among some that the pharmaceutical industry and/or the FDA have patients’ best interests in mind. High-profile cases in the media have highlighted the gap between patient expectations for compassionate use and company utilisation of fair processes to adjudicate requests. With many pharmaceutical manufacturers, patient groups, healthcare providers and policy analysts unhappy with the inequities of the status quo, fairer and more ethical management of compassionate use requests was needed. This paper reports on a novel collaboration between a pharmaceutical company and an academic medical ethics department that led to the formation of the Compassionate Use Advisory Committee. Comprising medical experts, bioethicists and patient representatives, CompAC established an ethical framework for the allocation of a scarce investigational oncology agent to single patients requesting non-trial access. This is the first account of how the committee was formed and how it built an ethical framework and put it into practice. (shrink)

The development of her position involves the following representative moves: In the first stage of her discussion, she highlights the possible presence of an implicit, untested, and potentially false proposition (...) underlying my general argument, namely, that proper theorizing about ourselves and the world may provoke changes in our beliefs and any behaviors based on them. In the second stage of her project, she expresses a paradigmatically analytic mode of skepticism; this doubt concerns a "chain of events" implicit in the development of my position, and it takes the form of a set of questions that bear a strong family resemblance. First, Ross questions the very possibility or intelligibility of using fictional discourse and philosophical theory to explore the ways in which addicts conceive of themselves and their circumstances. Next, Ross turns to a more psychological (and intellectually profitable) line of questioning: Do people struggling with drug abuse and addiction have similar self-conceptions that, moreover, are meaningfully distinct from those expressed by nonusers? How might such idiosyncratic and shared modes of self-understanding instruct us about the disease of addiction? Finally, in what sense (if any) might certain alterations in our conceptual schemas have practical rehabilitative value? Having voiced uncompromising doubt concerning my pragmatic appropriation of philosophy and literature, Ross proceeds to an unlikely third step in her argument: She insists that my project is entirely theoretical, in the sense that I focus exclusively on truth-evaluable claims (about addicts' conceptions of self and world) that are garnered from literary narratives. Relatedly, she takes issue with my strong Wittgenstenian intuition about the presence of some intimate connection between linguistic self-expression and an individual's conceptual framework, insisting that I neglect "the degree to which the narratives are [not] honest, veridical expressions of self-conceptions" (228). Ross urges me to recognize that the language employed in narratives of drug abuse and addiction "might be said to reflect the addict's observations concerning his or her self-hood, or, alternatively, what the addict cares to portray about this conception, however truthful" (228). From her analytic-philosophical perspective, these features of language, combined with sensible intuitions about the practical limitations of theorizing, motivate a critique of my overall project. Instead, I clarify further my project and its intended results, in such a way that opens up space for her analytic voice within the context of an interdisciplinary discussion. Ross and I agree on two absolutely central concerns: First, her description of the proper significance of the language under study is perfectly apt, if ultimately irrelevant as a criticism of my work. Of course, I concede the obvious point that the narratives I consider are not perfectly veridical, reliable, or honest. Yet far from being a problem, these rhetorical features make the narratives appropriate and fruitful objects of study. Through the use of philosophical tools and literary-critical practice, I seek primarily to develop an understanding of the ways in which addicts portray their subjectively informed, culturally conditioned, and selectively edited self-observations. Second, I would like to underline Ross' helpful reminder about the contingency of the hypothetical claims I develop through close reading and philosophical references. Our agreement about these fundamental points may reflect my own failure to describe clearly my procedure and desired results. Faith in this proposition is what motivates many of us to teach. But, alas...Allison Mitchell's argument for rethinking addiction intervention—in particular, rethinking twelve-step programs—is premised on this proposition. According to her argument, addicts function with an impoverished sense of self that is reflective of a grossly simplified form of philosophical materialism. By recognizing the limitations of this philosophically unconvincing view, and by, in effect, accepting a better, more complete materialism, addicts can come to modify their self-conception. This modification is instrumental to recovery.A careful consideration of the chain of events being proposed, and the problems with it, is helpful for understanding the limitations of her argument. In this paper I chart the seismic shift that has occurred over the past three decades in attitudes towards the interpretation of visual images. My strategy implies the argument that the reading of visual images would appear to be an inevitability given the accelerating change of attitudes towards pictures as containers of determinate knowledge. French critical theorists (Foucault, Barthes, Derrida et. al.) dominated debate on interpretation of text and image in the 1980s, where my survey begins. Michel Foucault dismissed the (...) image (in Madness and Civilization 1959/1988) as a fascinating site for the madness of dreams but one standing outside of reasoned interpretation because of an inherent excess of meaning and deeply hidden attributes and allusions. Generally, however, when images were discussed using identifiable interpretive strategies in the 1980s the framework was a variant of semiotic analysis (Marin, Eco and Barthes – who famously, diverges from this mode in Camera Lucida). I use W. J. T. Mitchell’s Iconology: Image, Text, Ideology 1986 as a focal text from the 1980s and follow this with two of his publications on images, one from 1995 and another from 2005 to demonstrate the dramatic shift in the approach to pictures across almost three decades. Around these focal texts by Mitchell I reference other texts and trends that culminate in the more recent proliferation of texts related to visual studies and the re-emergence of aesthetics. I call these image-permitting metaphors, and contrast them with image-demanding metaphors comprising a second category and whose understanding mandates the construction of a mental image. This construction, I suggest, is spontaneous, is not restricted to visual imagery, and its result is typically somatically marked (...) sensu Damasio. IDM’s are characteristically used in service of self-expression, and thereby in the elicitation of empathy. Even so, IDM’s may reasonably provoke banter over the aptness of the imagery they evoke. Aristotelian Actualism is the conjunction of the theses that absolutely everything is actual, that individuals are neither reducible to nor dependent on independently identified properties, and that some individuals are genuine contingent existents. Robert Adams and Gregory Fitch, two prominent proponents of Aristotelian Actualism, have argued that this view has a consequence that any modal logic stronger than M, and so any modal logic in which symmetry and reflexivity are frame conditions, is inadequate. We argue that this is incorrect.

It is a familiar feature of our affective psychology that our moods ‘crystalize’ into emotions, and that our emotions ‘diffuse’ into moods. Providing a detailed philosophical account of these affective shifts, as I will call them, is the central aim of this paper. Drawing on contemporary philosophy of emotion and mood, alongside distinctive ideas from the phenomenologically-inspired writer Robert Musil, a broadly ‘intentional’ and ‘evaluativist’ account will be defended. I argue that we do best to understand important features of these (...) affective shifts – which I document across this paper – in terms of intentional and evaluative aspects of the respective states of moods and emotion. At same the time, the account is pitched at the phenomenological level, as dealing with affective shifts primarily in terms of moods and emotions as experiential states, with respect to which it feels-like-something to be undergoing the relevant affective experience. The paper also applies the intentional-evaluative model of affective shifts to anxiety in more detail, developing the idea that certain patterns of affective shift, particularly those that allow for a kind of ‘emotional release’, can contribute to a subject’s well-being. This paper describes a network of three interconnected, multidisciplinary research projects designed to investigate environmental health issues faced by First Nations in Canada. These projects, developed in collaboration with academia, used a participatory approach meant to build capacity, raise awareness, and initiate change. The first project, which began in British Columbia in 2008, gathered information on the traditional diet; for example, its composition, nutritional quality, and potential for chemical exposure. This 10-year, Canada-wide project served as a model for two follow-up (...) projects: one on biomonitoring and another on indoor air quality. All three projects provided community ownership over the data and communicated results in a culturally sensitive manner to encourage interest in research and initiate risk reduction activities. The Assembly of First Nations, a national advocacy organization representing over 630 First Nations communities across Canada, participated in all aspects of the research while coordinating communications and arranging timely dissemination of results. These projects showed how properly executed, community-based research can be a valuable tool for stimulating interest in scientific studies while promoting self-reliance, components often missing from academic research. Philosophers of criminal punishment widely agree that criminal punishment should be “proportional” to the “seriousness” of the offense. But this apparent consensus is only superficial, masking significant dissensus below the surface. Proposed proportionality principles differ on several distinct dimensions, including: regarding which offense or offender properties determine offense “seriousness” and thus constitute a proportionality relatum; regarding whether punishment is objectionably disproportionate only when excessively severe, or also when excessively lenient; and regarding whether the principle can deliver absolute judgments, or only (...) comparative ones. This essay proposes that these differences cannot be successfully adjudicated, and one candidate proportionality principle preferred over its rivals, in the abstract; a proportionality principle only makes sense as an integrated part of a more complete justificatory theory of criminal punishment. It then sketches a proportionality principle that best fits the responsibility-constrained pluralist theories of criminal punishment that currently predominate. The proportionality principle it favors provides that punishments should not be disproportionately severe, in noncomparative terms, relative to an agent’s culpability in relation to their wrongdoing. The first principle of the Nuremberg Code requires the informed consent of the subject. Proxy consent was not addressed until the Declaration of Helsinki. U.S. policies regarding consent for the participation of children in research would not be finalized for almost two more decades in subpart D of the federal regulations that govern the participation of subjects in research. In October 2000, the Children's Health Act was passed. Title X required the Secretary of the Department of Health and Human Services (...) to conduct a review of the regulations under subpart D and “to consider any modifications necessary to ensure the adequate and appropriate protection of children participating in research, and report the findings of the Secretary to Congress.” In this article, I provide a brief overview of the current informed consent requirements in pediatric research, which include requirements for parental permission and the child's assent. I then examine the moral bases for these requirements; whether the current policies are consistent with these moral foundations; and if not, how the policies ought to be modified. a. (shrink)

Harvey Mitchell’s book argues that a reassessment of Voltaire’s treatment of traditional Judaism will sharpen discussion of the origins of, and responses to, the Enlightenment. His study shows how Voltaire’s nearly total antipathy to Judaism is best understood by stressing his self-regard as the author of an enlightened and rational universal history, which found Judaism’s memory of its past incoherent, and, in addition, failed to meet the criteria of objective history—a project in which he failed. Calling on an array (...) of Jewish and non-Jewish figures to reveal how modern interpretations of Judaism may be traced to the core ideas of the Enlightenment, this book concludes that Voltaire paradoxically helped to foster the ambiguities and uncertainties of Judaism’s future. Pragmatism as a political theory develops a critical perspective, a sensitivity to context and situation, and a collaborative and interactive engagement of personal experiences that test theories. Given this focus, however, the subject matter of pragmatism does not engage issues of gender. Pragmatism, nevertheless, can be used as a tool to address and handle feminist concerns. The link between pragmatism and feminism can be made by emphasizing pragmatists' efforts to align rationality with praxis. That is, pragmatism can be analyzed in (...) such a way as to break the traditional link of rationality to masculinity and the link of practical life to femininity. However, in so doing, there remains a residue of unmechanized assumptions and cultural attitudes that makes the link between women's experiences and philosophical praxis difficult to establish and maintain. Thus, while this dissertation critiques the absence of an analysis of gender within epistemology generally, it also proposes a new theory of knowledge: engendered pragmatism. It is a theory of knowledge as situated, created by gendered individuals within particular communities. ;I do not provide a feminist critique of pragmatism in which large parts of pragmatism are altered, replaced or repudiated. I provide a new view of what epistemological problems within the pragmatic tradition entail, not a new interpretation of the problems. Engendered pragmatism does not simply involve a process of highlighting women's experiences where pragmatism can solve the problems of gender issues. As a theory, engendered pragmatism is not simply the application of pragmatism to women's experiences. My claim is that one cannot be a pragmatist without being a feminist. ;However, one cannot be a feminist pragmatist without addressing two problems within feminist epistemology. There is a tendency within feminist epistemology to universalize and, simultaneously, to relativize women's experiences. This tendency creates the perception that women's experiences are personal truths. From a pragmatist perspective, the value of a woman's standpoint should not be couched in terms of the issue of truth. Engendered pragmatism, as a theory, encourages feminist epistemologists to use the plurality of personal experiences as practical tools for a pragmatic conception of knowledge as warrantability, not truth.
